What constitutes Breach or Default of your OBX Long Term Rental Lease?
Tenant default of a North Carolina Residential Rental Contract could be for many more items other than nonpayment which is the most common tenant default. OBX Housing has had our Lease customized by our local Attorney so that no Notice of Default must be sent to our Tenants for tenant default by nonpayment.
If a tenant does not pay their rent when due, OBX Housing has the right to file for summary ejectment (eviction) immediately with no notice to the tenant. This expedites Landlord having the tenant removed from the property and gaining possession of the home so that it may be turned over and the Landlord can start making money again.
Other items that would constitute Tenant Default would include:
-storing vehicles at the property either not in the driveway or those that do
not have current tags or registration.
-storing debris outside of home either in the yard or under the home.
-having a pet on a property without permission.
-having roommates at the home without permission.
In instances of default such as those listed above, the procedure we must follow is to provide written notification of default to the Tenant and give them 5 days to remedy the default. We set an inspection for the 6th day after the notification is issued and go to the property to make sure the default has been remedied. If so, then we document that everything is back in good shape. If not, then we file for summary ejectment (eviction) based on default.
